1. Acceptance of Terms
By accessing or using the services provided by Blue Engine you agree to be bound by these Terms of Service. If you do not agree with these Terms, you may not access or use our services.
2. Services
Blue Engine provides:
- AI-powered SMS communication
- Appointment scheduling
- Lead qualification
- CRM automation
- Follow-up automation
- Business messaging services
- Customer communication workflows
Blue Engine does not guarantee:
- Sales
- Revenue
- Lead conversion
- Appointment attendance
- Business growth
3. Customer Responsibilities
You represent and warrant that:
- You own or have legal rights to all contact data uploaded.
- You obtained all required consent before messaging contacts.
- You comply with all applicable laws, including TCPA, CTIA, FCC, carrier, and state messaging regulations.
- You will not upload purchased or scraped lead lists without proper consent documentation.
4. SMS Compliance
Clients are solely responsible for ensuring proper consent has been obtained before messaging consumers. By using our platform, you acknowledge that consent records must be maintained, opt-out requests must be honored, and messaging must comply with applicable laws and carrier requirements. Blue Engine may disable messaging services for suspected violations.
5. AI Communications Disclosure
Our services may utilize artificial intelligence to communicate with leads and customers. By interacting with our systems, you acknowledge that responses may be generated by automated systems, that conversations may be monitored for quality assurance, and that AI-generated responses are not legal, financial, tax, medical, or professional advice.
6. Message Frequency
Message frequency varies based upon customer interaction and campaign settings. Message and data rates may apply. For assistance, reply HELP. To stop receiving messages, reply STOP.
7. Intellectual Property
All software, workflows, automations, AI systems, and proprietary processes remain the exclusive property of Blue Engine. Clients receive a limited, non-transferable license to use the services during an active subscription.
8. Limitation of Liability
To the fullest extent permitted by law, Blue Engine shall not be liable for lost profits, lost revenue, lost business opportunities, indirect damages, consequential damages, carrier filtering, carrier blocking, or delivery failures. Maximum liability shall not exceed fees paid by Client during the preceding three months.
9. Indemnification
Client agrees to defend, indemnify, and hold harmless Blue Engine from any claims arising from improper consent collection, TCPA violations, privacy violations, illegal messaging, uploaded data, or lead sources.
10. Termination
Blue Engine may suspend or terminate services immediately for non-payment, abuse, spam complaints, carrier violations, or regulatory violations.
11. Governing Law
These Terms shall be governed by the laws of the State of Arizona. Any disputes shall be resolved in Arizona courts.
